Terms of Service
Last updated: 28 September 2026. Applies to new accounts from this date. For existing account holders, these Terms take effect on 12 October 2026.
Tale Twirlers is a storytime service for families, operated by Pondr Group Pty Ltd trading as Tale Twirlers (ABN 33 600 151 513, ACN 600 151 513) of Unit 501, 4–6 Gold Street, Collingwood VIC 3066, Australia ("Tale Twirlers", "we", "our", "us").
These Terms of Service ("Terms") cover the Tale Twirlers native app for iPhone and iPad, the Tale Twirlers website at taletwirlers.com, and everything connected to them (together, the "Service"). When you create an account or use the Service, you're agreeing to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.
Each section below starts with a short plain-English summary. The summary is there to help you understand the section; if the summary and the full text ever differ, the full text is what applies.
1. Who Can Hold an Account
In short: accounts are for grown-ups. Your child uses the Service through your account, and you're responsible for what happens on it.
Tale Twirlers is designed for children to enjoy with a parent or guardian. The account belongs to the adult, not the child.
By creating an account, you confirm that:
- you are at least 18 years old;
- you are the parent or legal guardian of any child who uses the Service through your account, or have their parent or guardian's permission; and
- you are responsible for all activity on your account, including anything a child does while using it.
We can't verify your age, so we rely on this confirmation. If we learn that an account holder is under 18, we will delete the account and its data.
Keep your login details private. If you think someone else has access to your account, tell us at hello@taletwirlers.com.
2. Signing Up
In short: you need an account to use the app or to save anything. Sign in with Apple, Google or an email address, and keep your details accurate.
You need an account to use the app and to do anything on the web beyond reading our free stories and story previews: saving progress, creating stories, becoming a member. You can create an account with Sign in with Apple, Google, or an email address and password. If you sign up with an email address, we may ask you to verify it. You can use the Service in the meantime, but some account-recovery features depend on a verified email.
You agree to give us accurate information and to keep it up to date. One account per person, please.
3. How Tale Twirlers Works
In short: there's a library of pick-your-path stories, all read aloud. Some are free for everyone. A membership opens the full library. Orbs let you create stories of your own.
The library. Tale Twirlers has a library of pick-your-path stories: your child chooses what happens next, and every story has more than one way through. Every story can be read aloud by a narrator. Members can read any story in the library. Everyone can read the stories we've made free, and can preview the opening pages of any other story.
Story creation. Your child can create a story by picking a character, a place and an adventure. We match those choices to a story we've already written and illustrated, so every created story has been reviewed before your child ever sees it. Created stories are saved to your account and are yours to read as often as you like (see section 7 for what "yours" means legally). Each creation uses one Orb.
Orbs. Orbs are the in-app currency used for story creation. You get one Orb free when you sign up, members receive one Orb each month, and Orb packs can be purchased. Section 5 explains Orbs in detail.
The library grows over time, and we may add, change or retire stories and features. We'll always try to make changes that make the Service better for families.
4. Membership
In short: membership gives you the full library on iPhone, iPad and the web. There's a free trial to start. It renews automatically until you cancel, and you can cancel any time.
In these Terms, a "member" is an account holder with an active membership, whether paid or in a free trial. If you have an account but no membership, you're on the free tier.
4.1 What membership includes
A Tale Twirlers membership gives you access to the full story library on every platform we support, plus one Orb each month while your membership is active. Membership is a subscription that gives you access to the library for as long as you're a member. You don't own the library stories individually (see section 7).
4.2 Plans and pricing
We offer annual and monthly plans. Current prices are shown in the app and on our website when you subscribe, in your local currency where available and inclusive of any applicable taxes we're required to charge. Prices may differ slightly between platforms and countries.
4.3 The free trial
If you've never had a membership before, you can try Tale Twirlers free. The trial length (currently 7 days) is shown before you start, and we may offer different trial lengths at different times. How the trial works depends on where you start it:
- On the web: no payment details are needed. When the trial ends, your account simply returns to the free tier. You are never charged unless you choose to subscribe.
- In the app: you start the trial through Apple's payment sheet, and a payment method is required. When the trial ends, you're charged for the plan you chose and your membership begins, unless you cancel at least 24 hours before the trial ends.
We tell you exactly how long the trial is and what happens at the end of it before you start. The trial is available once per person. Because web trials don't require payment details, we may decline or end a trial if we reasonably believe someone is creating multiple accounts to get repeat trials.
4.4 Renewal
Memberships renew automatically at the end of each billing period, at the price shown when you subscribed (or the price we've since notified you of under section 4.7), until you cancel.
4.5 Cancelling
You can cancel at any time. Cancellation takes effect at the end of your current billing period. You keep full access until then, and you won't be charged again.
- Subscribed in the app: cancel through your Apple ID subscription settings (Settings → your name → Subscriptions). Deleting the app does not cancel your membership.
- Subscribed on the web: cancel in your account settings on taletwirlers.com, or email hello@taletwirlers.com and we'll do it for you.
Section 8 explains what you keep when your membership ends.
4.6 One membership, every platform
Your membership is tied to your Tale Twirlers account, not the device you bought it on. Sign in with the same account on the app or the web and your membership comes with you. Your billing stays with the platform where you subscribed.
4.7 Price changes
If we change the price of your plan, we'll tell you at least 30 days before the new price applies, by email or in the app. The new price applies from your next renewal after that notice, and you can cancel before then if you'd rather not continue. For memberships purchased through Apple, Apple's own price-change process applies, which may ask for your consent before a new price takes effect.
4.8 Failed payments
If a renewal payment fails, whether through Apple or on the web, your membership continues for 3 days while the payment is retried, and you'll be notified so you can update your payment details. If payment still hasn't gone through after that, your account returns to the free tier. You won't lose your created stories, Orbs or anything you've purchased, only library access, and you can resubscribe whenever you like.
5. Orbs
In short: Orbs are for creating stories. They're not money, can't be cashed out or transferred, and they stay in your account if your membership ends. If we ever introduce limits on Orbs, we'll give you fair notice.
5.1 Getting and using Orbs
- You receive one free Orb when you create your account.
- Members receive one Orb each month while their membership is active. Your first monthly Orb arrives when your first payment goes through, and each one after that on your billing anniversary each month (adjusted for shorter months). Monthly Orbs aren't delivered during a free trial or while a payment is outstanding, and missed months aren't added later.
- Orb packs can be purchased in the app (through Apple) or on the web (through Stripe) whether or not you're a member.
- Each story creation uses one Orb. We may add other things Orbs can be used for in future; we'll tell you when we do.
5.2 What Orbs are and aren't
Orbs are a limited licence to use a feature of the Service. They:
- have no cash value and can't be exchanged for money;
- can't be transferred, gifted, sold or moved between accounts;
- are only usable within the Service; and
- are not refundable once purchased, except where the law gives you a right to a refund (see section 6).
5.3 Orbs and your membership
Orbs and membership are separate. Ending your membership doesn't remove your Orbs. They stay in your account and you can keep using them. Buying Orbs doesn't give you library access; that's what membership is for.
5.4 Limits and expiry
Right now Orbs don't expire and there's no cap on how many you can hold. We may introduce a cap or expiry period in future. If we do, we'll give you at least 30 days' notice in the app or by email, and we won't take away Orbs you've paid for without giving you a fair chance to use them first.
5.5 Account deletion
If you delete your account, any unused Orbs are permanently forfeited and can't be refunded (see section 11).
6. Refunds and Your Consumer Rights
In short: you can always cancel, but paid time already used generally isn't refunded. Apple handles refunds for purchases made in the app; we handle refunds for web purchases. Your legal consumer rights always apply, and nothing here takes them away.
6.1 Purchases made in the app
Membership and Orb packs bought in the app are purchased from Apple. Apple handles billing, receipts and refunds under its own terms. To request a refund, go to reportaproblem.apple.com. We can't issue refunds for App Store purchases ourselves, but we're happy to help if something has gone wrong. Email hello@taletwirlers.com.
6.2 Purchases made on the web
Because you can cancel at any time and keep access until the end of your billing period, we don't generally refund membership fees for the remainder of a period you've already paid for, or for change of mind. We will refund you where:
- you were charged in error, charged twice, or charged without your authorisation;
- a technical problem on our side stopped you using the Service for a significant part of your billing period and we couldn't fix it in a reasonable time; or
- the law requires it.
To request a refund, email hello@taletwirlers.com with the email address on your account and what happened. We aim to respond within 5 business days and process approved refunds within 10 business days to your original payment method.
6.3 If you're in the European Union or United Kingdom
You have the right to cancel any web purchase, membership or Orb pack, within 14 days of making it and receive a full refund, without giving a reason. If you cancel a membership, library access ends when we refund you. If you cancel an Orb pack, any unused Orbs from that pack are removed and stories created with them are no longer available. To exercise this right, email hello@taletwirlers.com within the 14 days.
6.4 Your statutory rights
Nothing in these Terms limits any rights you have under consumer protection law that can't be excluded by contract, including the Australian Consumer Law, the New Zealand Consumer Guarantees Act 1993, the UK Consumer Rights Act 2015, and equivalent laws in the EU, Canada, the United States and elsewhere. If our Service fails to meet a guarantee under those laws, you're entitled to the remedies they provide.
7. Content and Your Licence to Use It
In short: we own or license everything in Tale Twirlers. You get a personal licence to enjoy it. The stories your child creates stay yours to read even if your membership ends. Please don't copy or share content outside the Service.
7.1 Our content
Everything in the Service (stories, text, characters, illustrations, narration, audio, design, software and trademarks, together the "Content") is owned by or licensed to Tale Twirlers and protected by copyright and other intellectual property laws. Some Content is created using our own systems, including AI tools; all of it has been reviewed before it appears in the Service.
7.2 Your licence
We give you a personal, non-exclusive, non-transferable licence to access and enjoy Content within the Service for private, family use. This means reading and listening on your own devices, with your own family.
Library stories are available to you while you have access to them, through membership or because we've made them free.
Created stories are different. A story your child creates is saved to your account with a personal licence that continues even after your membership ends, for as long as your account exists. That's what we mean when we say created stories are yours to keep. The licence ends only if you delete your account or seriously breach these Terms.
7.3 What you can't do
You may not copy, download, record, distribute, publish, sell, adapt or publicly perform any Content outside the Service, or remove any copyright or trademark notices. You may not use Content to train or develop any machine learning or AI system. If we provide a sharing feature, you may use it as intended, and only that way.
7.4 Feedback
If you send us ideas or suggestions, we can use them without owing you anything. We love hearing from families, and we'd rather this not be a barrier to telling us what you think.
7.5 If you think Content infringes your rights
We take intellectual property seriously and we don't want anything in Tale Twirlers that shouldn't be there. If you believe Content in the Service infringes your copyright or other rights, email hello@taletwirlers.com with: a description of the work you believe has been infringed, where the Content appears in the Service, your contact details, and a statement that you believe in good faith the use isn't authorised. We'll investigate promptly and remove or disable access to Content where appropriate.
8. When Your Membership Ends
In short: you lose the full library. You keep everything else.
When your membership ends, whether you cancelled or a payment failed, your account returns to the free tier. Here's exactly what that means:
| Member | Free tier | |
|---|---|---|
| Full story library | Yes | No. Free stories and previews only |
| Stories your child has created | Yes | Yes, kept |
| Anything purchased with Orbs | Yes | Yes, kept |
| Unused Orbs | Yes | Yes, kept |
| Creating new stories | Yes, with Orbs | Yes, with Orbs |
| Monthly Orb | Yes | No |
You can rejoin at any time and pick up where you left off.
9. About Our Stories
In short: stories are for enjoyment. Narration is AI-generated and occasionally imperfect. Tale Twirlers is an addition to storytime, not a replacement for grown-ups.
Tale Twirlers is an entertainment service. Our stories are written to be enjoyed by children aged roughly 3 to 7 with a grown-up nearby. They're not a substitute for parental supervision, and we don't make any promise that the Service will teach a particular skill or produce a particular outcome.
Narration in the Service is generated using AI voice technology. We work hard on quality, but narration may occasionally contain mispronunciations or small errors. Non-fiction stories are checked for accuracy, but if you spot something that's wrong or that you think isn't suitable for children, please tell us at hello@taletwirlers.com and we'll look into it quickly.
10. Using the Service Fairly
In short: use Tale Twirlers as it's meant to be used, and don't try to break it or take it apart.
You agree not to:
- copy, scrape, download or extract Content or data from the Service, whether manually or with automated tools;
- reverse-engineer, decompile or attempt to access the source code of the Service;
- circumvent any access controls, payment systems or usage limits, including Orb limits or trial restrictions;
- interfere with the Service's operation or security, or attempt to access other users' accounts or data;
- use the Service for any commercial purpose, including in a classroom, childcare or business setting, without our written permission (we're open to it, just ask);
- share your account or login details outside your household; or
- use the Service in any way that breaks the law.
If you breach these Terms, we may suspend or terminate your account. If the breach is serious, we may do so without notice and without refunding any fees or Orbs.
11. Deleting Your Account
In short: you can ask us to delete your account from inside the app or on the web. We action it ourselves so a child can't do it by accident. Deletion is permanent.
You can request deletion of your account at any time from the account settings in the app or on the website. Deletion requests are actioned by our team rather than happening instantly, to protect families from a child accidentally deleting their account and its stories. We complete deletion within 30 days of your request, and we'll confirm by email when it's done.
Once your account is deleted:
- your account data, created stories and reading history are permanently removed;
- any unused Orbs are forfeited;
- if you subscribed on the web, your membership is cancelled automatically;
- if you subscribed through Apple, deleting your account does not cancel that subscription. Apple doesn't let us cancel it for you, so you must cancel it yourself through your Apple ID settings, or Apple will keep charging you; and
- the account can't be recovered.
No refunds are available for deleted accounts, except where the law requires them. Our Privacy Policy explains what happens to your personal information when your account is deleted.
12. Availability and Changes
In short: we'll keep Tale Twirlers running as well as we can, but sometimes things break. We'll keep improving it, and we'll tell you about big changes.
We aim to keep the Service available at all times, but we can't guarantee it will be uninterrupted or error-free. We may need to suspend the Service for maintenance, updates or reasons outside our control.
We're constantly improving Tale Twirlers, and we may change, add or remove features and Content. If we make a change that materially reduces what your membership gives you, we'll tell you in advance and you'll be able to cancel.
If we ever decide to close Tale Twirlers entirely, we'll give you at least 30 days' notice, refund any prepaid membership period we can't deliver, and refund any Orbs you've paid for but not used. Free and monthly Orbs, created stories and everything else in your account end with the Service, though where we can, we'll give you a way to save your created stories before we close.
13. Our Responsibility to You
In short: we stand behind our Service and your legal rights are protected. Beyond that, our liability is limited in the ways the law allows.
13.1 What we don't limit
Nothing in these Terms limits or excludes our liability for anything that can't be limited or excluded by law. That includes our obligations under consumer protection law (see section 6.4), liability for death or personal injury caused by our negligence, and liability for fraud or fraudulent misrepresentation.
13.2 What we do limit
Subject to section 13.1:
- The Service is provided on an "as is" and "as available" basis. To the extent the law allows, we exclude all warranties and guarantees that aren't set out in these Terms, including any implied warranties of merchantability or fitness for a particular purpose, and we don't promise the Service will meet your particular requirements.
- We're not liable for any indirect, incidental, special or consequential loss, or for loss of data, arising from your use of the Service.
- Our total liability to you for all claims relating to the Service in any 12-month period is limited to the greater of AUD $100 and the amount you paid us in that period.
Where the law lets us limit our liability for a failure to meet a consumer guarantee, our liability is limited to resupplying the Service or refunding what you paid for it, at our choice.
13.3 Your responsibility to us
You agree to compensate us for any loss we suffer because of your serious breach of these Terms or your unlawful use of the Service.
14. The App Store
In short: if you use the app, some extra terms Apple requires also apply, but your agreement is with us, not Apple.
These Terms are between you and Tale Twirlers. Apple isn't a party to them and isn't responsible for the app or its Content. The following terms apply to the iOS app and are required by Apple:
- Licence scope. Your licence to use the app is limited to a non-transferable licence to use it on Apple devices you own or control, as permitted by the App Store's usage rules.
- Maintenance and support. We're responsible for any maintenance and support of the app. Apple has no obligation to provide either.
- Warranty. If the app fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you (the app is free to download, so in practice this is nil). To the maximum extent permitted by law, Apple has no other warranty obligation for the app; anything else is our responsibility.
- Claims. We, not Apple, are responsible for addressing any claims relating to the app or your use of it, including product liability claims, claims that the app fails to meet a legal or regulatory requirement, and consumer protection claims.
- Intellectual property. If a third party claims the app infringes their intellectual property rights, we, not Apple, are responsible for investigating, defending, settling and discharging the claim.
- Legal compliance. You confirm that you're not located in a country subject to a US Government embargo or designated as "terrorist supporting," and that you're not on any US Government list of prohibited or restricted parties.
- Third-party terms. You must comply with any applicable third-party terms when using the app.
- Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you as such.
Our contact details are in section 18.
15. Changes to These Terms
In short: if we change these Terms in a way that matters, we'll tell you before it takes effect.
We may update these Terms from time to time. Small changes, such as fixing a typo or clarifying wording, take effect when we publish them. If we make a material change, we'll tell you at least 30 days before it takes effect, by email or in the app, and you'll be able to cancel if you don't want to continue under the new Terms. Using the Service after a change takes effect means you accept it.
The date at the top of this page shows when these Terms were last updated.
16. Governing Law and Disputes
In short: Australian law applies, but your local consumer protections still count. If something's wrong, talk to us first. We'll do our best to fix it.
These Terms are governed by the laws of Victoria, Australia. If you live outside Australia, you also have the benefit of any mandatory consumer protection laws in your country, and you can bring a claim in your local courts if the law entitles you to.
If you have a problem with the Service, please email hello@taletwirlers.com first. Most issues can be sorted out quickly and informally, and we'd much rather do that. If we can't resolve it together, you may have the right to take your complaint to a consumer protection body in your country.
17. General
If any part of these Terms is found to be unenforceable, the rest continues to apply. If we don't enforce a right under these Terms, that doesn't mean we've waived it. You can't transfer your account or your rights under these Terms to anyone else. We may transfer our rights to a company that takes over Tale Twirlers, provided your rights aren't reduced. These Terms, together with our Privacy Policy, are the whole agreement between you and us about the Service.
