Terms of Service

1. Eligibility & Account Responsibility

Tale Twirlers is a family-oriented storytelling service designed to be enjoyed by children under the supervision of a parent or legal guardian.

By creating an account, you represent and warrant that:

• you are at least 18 years old, and
• you are responsible for all activity conducted through your account.

You are responsible for maintaining the confidentiality of your login credentials and for all use of the Service under your account.

2. Account Registration

You may register using:

• email address (with verification), or
• third-party sign-in providers such as Apple or Google.

You agree to provide accurate, current, and complete information and to keep your account details up to date.

3. How Tale Twirlers Works

Orbs (In-App Currency)

Tale Twirlers uses an in-app currency called Orbs, which may be obtained through:

• subscriptions, or
• one-off purchases.

One Orb is consumed each time a new story is generated.

Story Library Access

Once a story is generated, it is added to your account and may be read or listened to multiple times without consuming additional Orbs.

Generated stories remain accessible even if a subscription ends, provided your account remains active.

Non-Transferable

Orbs and stories:

• are tied to your account,
• have no cash value, and
• cannot be transferred, sold, or redeemed.

4. Subscriptions & Payments

Payments are processed via:

• Apple Pay for in-app purchases, and
• Stripe for web purchases.

Tale Twirlers does not store payment card details.

Subscriptions automatically renew unless cancelled through your App Store account or web account settings before the renewal date.

Refunds for in-app purchases are handled by Apple in accordance with App Store policies.

Nothing in these Terms excludes rights you may have under applicable consumer laws, including the Australian Consumer Law and the New Zealand Consumer Guarantees Act.

5. Story Ownership & Intellectual Property

All stories, text, characters, artwork, narration, and other content generated through the Service ("Stories") are created using Tale Twirlers' proprietary systems.

Ownership

Tale Twirlers retains all rights, title, and intellectual-property interest in all Stories and Service content.

Licence to You

You are granted a personal, non-exclusive, non-transferable, revocable licence to access and enjoy Stories within the Service only, for personal, non-commercial use.

You may not reproduce, distribute, sell, publish, or publicly display Stories outside the Service without prior written permission.

6. AI Narration & Content Disclaimer

Some Stories include AI-generated narration.

While we aim for quality and accuracy, narration may occasionally contain minor errors or variations.

Tale Twirlers does not guarantee that AI-generated content will be error-free or suitable for every purpose.

7. Acceptable Use

You agree not to:

• misuse the Service or attempt to circumvent safeguards;
• interfere with servers or system integrity;
• reverse-engineer or copy Service technology;
• use the Service for unlawful or commercial purposes without permission.

We may restrict, suspend, or terminate access where misuse occurs.

8. Content Moderation

We strive to provide safe, family-appropriate content.

If you encounter content you believe is unsuitable, please contact us via the Contact Us form.

We reserve the right to modify, remove, or restrict access to content or accounts to maintain a safe environment.

9. Service Availability

The Service may be unavailable from time to time due to maintenance, updates, or technical issues.

Tale Twirlers does not guarantee uninterrupted or error-free operation of the Service.

10. Account Deletion

You may request permanent deletion of your account through the Service.

Account deletion requests are reviewed and processed by Tale Twirlers to help prevent accidental deletion, particularly by children.

Once deletion is completed:

• all account data, stories, and unused Orbs are permanently removed;
• the account cannot be recovered; and
• no refunds or restorations are available.

11. Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect personal information.

By using the Service, you agree to our Privacy Policy.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement.

13. Limitation of Liability

To the maximum extent permitted by law, Tale Twirlers will not be liable for indirect, incidental, or consequential damages.

Our total aggregate liability for any claim relating to the Service will not exceed the greater of:

• AUD $100, or
• the amount you paid for the Service in the 12 months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless Tale Twirlers, its directors, employees, and partners from claims or damages arising from your misuse of the Service or breach of these Terms.

15. Governing Law

These Terms are governed by the laws of Victoria, Australia, without regard to conflict-of-law principles.

Local consumer-protection laws may also apply depending on your location.

16. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date reflects the latest version. Continued use of the Service constitutes acceptance of any changes.
